Governor seeks court's approval to name an attorney to probe Guam AG

Gov. Lou Leon Guerrero has petitioned the court to authorize her to appoint a special assistant attorney general and a special prosecutor to investigate and prosecute Attorney General Doug Moylan, alleging nepotism and other illegal hiring practices.

 

“This is an important step for our people, to hold leaders accountable for how they spend public monies,” Leon Guerrero said, taking Moylan to task for hiring more than 80 unclassified employees including his brother and fiancée.

 

“The attorney general has evaded accountability for too long because he is supposed to be the one prosecuting government corruption, not the one committing government corruption. A special prosecutor will finally help root out the corruption in the attorney general’s office,” the governor added.

 

In a petition for declaratory judgment, the governor asked the court to rule that the “Office of the Attorney General is unavailable to investigate or prosecute any potential criminal or civil claims” against Moylan and Chief Deputy Attorney General Guthrie.

The governor’s court request, filed by her attorney, Leslie Travis, cited the employment of the attorney general’s brother Scott Moylan, the promotion of his fiancée, Sheenalyn Hawkins, and the hiring of more than 80 unclassified employees.


 The governor said Guam law authorizes the OAG to hire only four unclassified employees and victim advocates.


“Since taking office in January 2023, AG Moylan has engaged in unlawful hiring and promotion practices within the Office of the Attorney General,” the governor said.


“Because these illegal acts were performed by Moylan and Guthrie, and, separately, because the acts affect OAG employees, the entire OAG is conflicted from performing or making decisions regarding potential investigations and prosecutions of Moylan and Guthrie,” reads the court filing.
